INCOME FROM COMMERCIAL ESTABLISHMENTS IN MUNICIPAL SPACES

What are the measures and who do they apply to?

Full exemption from paying rent for all commercial establishments in municipal spaces (municipal council or companies) that are closed. This measure is in force until June 30, 2020.

Kiosks and stores located in municipal neighborhoods, even if they remain open, benefit from the exemption.

The period of exemption from paying rent begins on April 1, 2020 and ends on June 30, 2020.

What income receipts correspond to the period of payment suspension?

The suspension of payment covers rents issued in the months of April, May and June.

Can I not join the new regime?

The decision is made by the tenant, who must communicate their intention to the Council.

Receipts will continue to be issued to allow those who so decide to maintain payment within the contractually established deadline.

Will I continue to receive receipts for rent payments?

Yes. Receipts will continue to be issued and will have a message informing the current measure, which grants an additional period of 18 months for payment, for anyone wishing to take advantage of these support measures.

The charging documents dated 04/01/2020 were already issued, before the decision on these measures and, therefore, have no indication.

I intend to continue making monthly rent payments, is it possible?

Yes. The announced measures are aimed at everyone, as part of the municipality’s response to the COVID-19 pandemic, to support families, businesses and employment.
However, you can always pay the rent monthly. In this case, after June 30th, you will not need to establish a way to settle the amounts owed.

I pay rent by Direct Debit. What is going to happen?

In CML this possibility does not exist, only in leases managed by GEBALIS.

For contracts that have active payment by Direct Debit, instructions will continue to be given to the bank to make the payment. Tenants may, within 56 days of the debt, request payment to be revoked. In this case, the amount deducted from the bank account will be returned and the debit authorization remains active for the following months.

If you cancel the direct debit authorization, there will be no further debits from your bank account. If you wish to activate this payment method again in the future, you will need to fill out a new form.

I can't pay the rent from April to June. How can I take advantage of the measure?

If you do not make the payment, CML will assume that you intend to take advantage of this measure. After June 30th, a phased payment plan will be implemented up to a limit of 18 months, without any interest or penalty.

How will unpaid amounts be paid?

After June 30th, you must regularize the payment of rent for a period of up to 18 months.

You can do it all at once or enter into a rent payment plan with monthly installments.

I live in a property allocated under the Conventioned Income/Affordable Income Program. Can I request a review of the rent value?

In the Conventional Income Program, the value of the rent does not depend on the household’s income. For this reason, the program does not provide for the possibility of reviewing the amount of income. However, here you can also pay unpaid rent from April to June for 18 months.

I have a Debt Settlement Agreement in place. Do I stop paying the installment for 3 months?

Whenever possible, you should pay pre-existing debts. If you do not pay these installments in April, May and June, your Settlement Agreement will be automatically reviewed from July onwards.

Can I request an income review during this period?

Yes. In a situation of reduced income, such as unemployment, sick leave, employees leaving or reduced income from work.

How can I request an income review?

Preferably, this can be done via email, telephone contact by the tenant/owner or recognized person, or by letter to be sent to CML/GEBALIS.

What are the essential documents I must present for the income review request?

Proof of the current income of all members of the household and declaration of household composition.

How to obtain the documents?

Social benefits:

  • Through Direct Social Security, website www.seg-social.pt (access using password)

Finances:

  • Green Receipts: Portal www.portaldasfinancas.gov.pt (access using password).

Income from work:

  • Pay slips and/or declaration from the employer.

If you do not have passwords, you must request them on the respective websites.
Please note that additional documentation may be requested in case of doubt.

My rental contract ends during the period of these measures. How should I proceed?

Lease contracts that end before June 30th are automatically extended until that date. The obligation to pay rent remains and you will be able to pay rent from April to June for 18 months.

If you wish to deliver the fire, you can do so by contacting the services.

Which companies are not covered by the payment exemption?

Those that, in accordance with the provisions of the State of Emergency decree-law, or by decision of the municipality, must remain in operation, or those that, if they must close, remain in operation.

Are stores and kiosks in Municipal Neighborhoods also covered?

Yes, whether they are open or closed.

Companies and Institutions. How will the payment exemption be made?

Settlement will continue to take place on the 3rd of each month. However, if payment is not made, until June 30th they will be considered exempt and until this date, no payment will go to tax enforcement proceedings.

Invoices will be issued with the contract value.

The charging documents dated 04/01/2020 were already issued, before these measures were decided and, therefore, do not provide for exemption from payment. However, these documents should only be paid for if the entities so wish.
